- PRIMERO. DEJAR SIN EFECTO el Auto del 7 de julio de 2008, proferido por el Tribunal Superior del Distrito Judicial de Barranquilla, Sala de Decisión Laboral.
- SEGUNDO. ORDENAR al Tribunal Superior del Distrito Judicial de Barranquilla, Sala de Decisión Laboral, resuelva de fondo la acción de tutela interpuesta por Mariela del Socorro Fortich Colina contra el Ministerio de la Protección Social, conforme a las previsiones del artículo 86 de la Constitución Política y del Decreto 2591 de 1991.
- TERCERO. Por Secretaría General COMUNÍQUESE al Consejo Seccional de la Judicatura del Atlántico, Sala Jurisdiccional Disciplinaria, con el fin de que tenga conocimiento sobre lo aquí resuelto por la Corte Constitucional en relación con el conflicto de competencia.
